Welcome to Rooted Human. In these Terms of Service, "we", "us" and "our" refer to Rooted Human, a brand of Ideal Direct Ltd. We operate this store and website, including all related information, content, features, tools, products and services, to provide you with a curated shopping experience (the "Services"). Rooted Human is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service, together with any policies referenced in them, describe your rights and responsibilities when you use the Services. Please read them carefully, as they include important information about your legal rights and cover areas such as warranty disclaimers and limitations of liability.

By visiting, interacting with or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, please do not use or access our Services.

Section 1: Access and account

By agreeing to these Terms of Service, you confirm that you are at least 18 years old and resident in the United Kingdom. Our Services are intended for UK customers only, and we currently ship only within the UK.

To use the Services, including browsing our store or placing an order, you may be asked to provide information such as your email address, billing, payment and shipping details. You confirm that all information you provide is correct, current and complete, and that you have the right to provide it.

You are responsible for keeping your account credentials secure and for all activity on your account. You may not transfer, sell, assign or licence your account to anyone else.

Section 2: Our products

Rooted Human products are food supplements and wellness items intended to support general wellbeing. They are not medicines and are not intended to diagnose, treat, cure or prevent any disease or medical condition. Always read the label and follow the recommended use.

If you are pregnant, breastfeeding, taking prescribed medication, or have a known medical condition or allergy, please consult your GP or a qualified healthcare professional before using our products. Keep all products out of reach of children unless specifically formulated for them, and do not exceed the recommended daily intake.

We have made every effort to represent our products accurately in our online store. Colours and appearance may vary slightly depending on your device and screen settings. We do not warrant that the appearance of any product will match exactly how it looks on screen.

All product descriptions, ingredients and formulations are subject to change without notice. We reserve the right to discontinue any product at any time and to limit quantities offered to any person or area.

Section 3: Orders

When you place an order, you are making an offer to purchase. We reserve the right to accept or decline any order at our discretion. Your order is only accepted once we confirm acceptance and have processed your payment. Please review your order carefully before submitting, as we may be unable to accommodate cancellation requests after an order is accepted. If we decline, change or cancel an order, we will contact you using the email, billing address or phone number you provided.

Returns and refunds are handled solely in accordance with our Returns and Refunds Policy. Because our products are consumable wellness items, we can only accept returns of items that remain unopened with seals intact.

You confirm that your purchases are for your own personal or household use and not for commercial resale or export.

Section 4: Prices and billing

Prices, discounts and promotions are subject to change without notice. The price charged for a product is the price in effect when your order is placed, as confirmed in your order confirmation email. Unless stated otherwise, posted prices include VAT where applicable but do not include shipping and handling.

Prices in our online store may differ from prices offered through third-party retailers such as Amazon. From time to time we may run promotions on the Services that are governed by their own terms. If those promotion terms conflict with these Terms, the promotion terms will apply for that promotion.

You agree to provide current, complete and accurate payment and account information for every purchase. You agree to keep your details up to date, including your email address and payment card information, so we can complete your transactions and contact you when needed.

You confirm that (i) the payment information you provide is true, correct and complete, (ii) you are authorised to use that payment method, (iii) charges incurred will be honoured by your card issuer, and (iv) you will pay all charges at the posted prices, including shipping and any applicable taxes.

Section 5: Shipping and delivery

We ship within the United Kingdom only. All delivery times shown on the site are estimates and are not guaranteed. We are not liable for delays caused by our shipping partners or events outside our reasonable control. In accordance with UK consumer law, risk of loss and damage passes to you when the products are delivered to you or to a person you have nominated to receive them.

Section 6: Intellectual property

Our Services, including all trade marks, brands, text, images, graphics, product reviews, video and audio, and the design, selection and arrangement of them, are owned by Rooted Human, Ideal Direct Ltd, their affiliates or licensors, and are protected by UK and international intellectual property laws.

These Terms allow you to use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, republish, download, store or transmit any material from the Services without our prior written consent. Nothing in these Terms grants you any licence or rights to any patent, trade mark, copyright or other intellectual property of Rooted Human, Ideal Direct Ltd, Shopify or any third party, except as expressly stated. Unauthorised use of the Services may breach UK intellectual property laws.

Rooted Human and Ideal Direct names, logos, product and service names, designs and slogans are trade marks of Ideal Direct Ltd or its licensors. You must not use them without our prior written permission. Shopify's name, logo and related marks are trade marks of Shopify. All other names, logos and marks on the Services are the trade marks of their respective owners.

Section 7: Optional tools

You may be given access to third-party tools through the Services. We do not monitor or have control over these tools and provide access to them "as is" and "as available", without any warranties, representations or endorsements of any kind. We are not liable for your use of any optional third-party tools.

Any use of optional tools is at your own risk, and you should make sure you are familiar with the terms on which they are provided by the relevant third party. New features we add to the Services in the future are also covered by these Terms of Service.

Section 8: Third-party links

The Services may contain links to third-party websites, or include third-party content. We are not responsible for examining or evaluating any third-party content and are not liable for any loss or damage relating to your use of those sites or any products or services bought through them. Please review the third party's own terms and privacy policies before engaging with them. Any complaints or queries about third-party products should be directed to that third party.

Section 9: Relationship with Shopify

Rooted Human is powered by Shopify, which enables us to provide the Services to you. However, any sales you make in our store are made directly with Rooted Human. Shopify is not responsible for any aspect of any sale between you and Rooted Human, including any loss or damage arising from products you purchase. You release Shopify and its affiliates from all claims, damages and liabilities arising from or relating to your purchases and transactions with Rooted Human.

Section 10: Privacy policy

Any personal information we collect through the Services is handled in accordance with our Privacy Policy, and certain personal information may also be subject to Shopify's Privacy Policy. By using the Services, you confirm you have read these policies.

Because the Services are hosted by Shopify, Shopify processes personal information about your use of the Services in order to provide and improve them. Information you submit through the Services may be transmitted to and shared with Shopify and other service providers that may be located outside the UK, in order to provide the Services. Section 11: Feedback and reviews

If you submit ideas, suggestions, feedback, reviews, proposals or other content (together, "Feedback"), you grant us a perpetual, worldwide, sublicensable, royalty-free licence to use, reproduce, modify, publish, distribute and display that Feedback in any medium for any purpose, including for commercial use. For example, we may quote a customer review on a product page or in marketing materials.

You also confirm that: (i) you own or have all necessary rights to all Feedback you submit; (ii) you have disclosed any compensation or incentive you received in connection with your Feedback; and (iii) your Feedback complies with these Terms. We are not obliged to keep Feedback confidential, to pay for it, or to respond to it.

We may, but are not required to, monitor, edit or remove Feedback that we consider unlawful, offensive, threatening, defamatory, obscene, or that infringes anyone's rights or breaches these Terms.

You agree that your Feedback will not infringe any third party's rights, will not be unlawful, abusive or obscene, and will not contain any virus or malicious code. You may not use a false email address, impersonate anyone, or mislead us about the origin of any Feedback. You are responsible for any Feedback you submit and its accuracy.

Section 12: Errors, inaccuracies and omissions

Occasionally information on the Services may contain typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, offers, shipping charges or availability. We reserve the right to correct any errors, update information and cancel orders if any information is inaccurate at any time without prior notice, including after you have placed your order. If we cancel an order for this reason and your payment has already been taken, we will refund you in full.

You may use the Services for lawful purposes only. You must not use the Services, directly or indirectly: (a) for any unlawful or malicious purpose; (b) to breach any UK or international law or regulation; (c) to infringe our intellectual property rights or those of anyone else; (d) to harass, abuse, defame, intimidate or harm any of our staff or any other person; (e) to transmit false or misleading information; (f) to send, receive, upload or use any material that does not comply with these Terms; (g) to send unsolicited advertising, junk mail, chain letters or spam; (h) to impersonate any other person or organisation; or (i) to do anything else that restricts other people's use of the Services, or that may harm Rooted Human, Ideal Direct Ltd, Shopify or any user.

You also agree not to: (a) upload viruses or any other malicious code; (b) reproduce, duplicate, copy, sell or exploit any part of the Services; (c) collect or track personal information about others; (d) spam, phish, scrape or crawl the Services; or (e) interfere with or circumvent any security features of the Services. We may suspend, disable or terminate your account at any time, without notice, if we consider you have breached these Terms.

Section 14: Termination

We may terminate this agreement or your access to the Services at any time, at our discretion, with or without notice. You remain liable for any amounts owed up to and including the date of termination.

The following sections will continue to apply after any termination: Intellectual Property, Feedback, Termination, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Waiver and Entire Agreement, Assignment, Governing Law, Privacy Policy, and any other provisions that by their nature should survive termination.

Section 15: Disclaimer of warranties

Information on the Services, including ingredient information, wellness content and articles, is provided for general information only. It is not medical advice and should not be relied on as such. Always speak to a qualified healthcare professional if you have questions about your health or before starting any new supplement.

Nothing in these Terms affects your statutory rights as a consumer under the Consumer Rights Act 2015 and other UK consumer protection law. We are required to provide products that are of satisfactory quality, fit for purpose and as described, and we honour those rights in full.

Subject to your statutory rights, and to the fullest extent permitted by law, the Services are provided on an "as is" and "as available" basis without any representations, warranties or conditions of any kind, whether express or implied. We do not guarantee that your use of the Services will be uninterrupted, timely, secure or error free.

Section 16: Limitation of liability

Nothing in these Terms limits or excludes our liability for: death or personal injury caused by our negligence; fraud or fraudulent misrepresentation; any breach of the implied terms in the Consumer Rights Act 2015 that cannot be excluded by law; defective products under the Consumer Protection Act 1987; or any other liability that cannot be limited or excluded under UK law.

Subject to the above, and to the fullest extent permitted by law, Rooted Human, Ideal Direct Ltd and our partners, directors, officers, employees, affiliates, agents, contractors, service providers and licensors, and those of Shopify and its affiliates, will not be liable for any loss of profits, loss of revenue, loss of savings, loss of data, replacement costs, or any indirect, incidental, special or consequential damages arising from your use of the Services or any product purchased through them, even if we were advised of the possibility.

Section 17: Indemnification

You agree to indemnify and hold harmless Rooted Human, Ideal Direct Ltd, Shopify and our affiliates, partners, officers, directors, employees, agents, contractors, licensors and service providers from any losses, damages, liabilities or claims, including reasonable legal fees, payable to any third party arising out of (1) your breach of these Terms or the documents they refer to, (2) your breach of any law or the rights of any third party, or (3) your access to and use of the Services.

We will notify you of any claim covered by this indemnity, although a failure to give prompt notice will not relieve you of your obligations unless you are materially prejudiced. We may take control of the defence and settlement of any such claim at your expense, including our choice of legal counsel, but will not settle any claim requiring non-monetary obligations from you without your consent, which you will not unreasonably withhold. You will cooperate in the defence of any indemnified claim, including by providing relevant documents.

Section 18: Severability

If any provision of these Terms is found to be unlawful, void or unenforceable, that provision will be enforceable to the fullest extent permitted by law, and the unenforceable portion will be severed from these Terms. The remaining provisions will continue in full force and effect.

Section 19: Waiver and entire agreement

Our failure to exercise or enforce any right or provision of these Terms will not be a waiver of that right or provision.

These Terms, together with any policies or operating rules we post on this site or in connection with the Services, are the entire agreement between you and us, and supersede any prior agreements or communications, whether oral or written, including any previous versions of these Terms.

Any ambiguity in these Terms will not be interpreted against the party that drafted them.

Section 20: Assignment

You may not assign, transfer or delegate this agreement or any of your rights or obligations under these Terms without our prior written consent, and any attempt to do so will be void. We may assign, transfer or delegate these Terms and our rights and obligations without your consent or notice.

Section 21: Governing law

These Terms and any separate agreements under which we provide Services are governed by the laws of England and Wales. You and Rooted Human agree to submit to the exclusive jurisdiction of the courts of England and Wales for any dispute arising out of or in connection with these Terms or the Services.

The headings used in these Terms are for convenience only and do not affect their interpretation.

We reserve the right to update, change or replace any part of these Terms by posting updates to our website. It is your responsibility to check this page periodically. We will notify you of any material changes in line with applicable law, and those changes will be effective on the date specified in the notice. Your continued use of the Services after any changes are posted means you accept those changes.
